Wreckshot Terms of Use

1. Agreement and eligibility

These Terms are an agreement between you and Muhammed Çelik, sole proprietor, trading as Celik Works (Türkiye) (“we”, “us”), for the game Wreckshot (the “Game”). By downloading or playing the Game you accept these Terms and confirm that you have read the Wreckshot Privacy Policy. If you do not agree, please do not play.

Wreckshot is rated 9+ on the App Store. If you are under 18, or under the age of majority where you live, you may play only with the permission of a parent or guardian, who accepts these Terms for you.

2. Your licence to play

On iPhone, the Game is licensed to you under Apple’s Licensed Application End User License Agreement (the “Apple Standard EULA”) and the App Store Usage Rules. These Terms add the rules for playing the Game and for its virtual items. If these Terms conflict with the Apple Standard EULA about the licence itself, the Apple Standard EULA applies.

Within that licence, you may download and play the Game on devices you own or control, for your own non-commercial entertainment. The licence is personal, limited, non-exclusive, non-transferable and revocable. All rights not expressly granted remain with us and our licensors.

3. Levels, stars and progress

You unlock levels by clearing them and earn up to three stars on each level by how much of the building you bring down. Levels, stars, best results and other progress:

• have no real-world monetary value and cannot be exchanged for money, cashed out, sold, traded or transferred;
• are licensed to you under these Terms, not sold;
• may be changed or rebalanced as we run the Game;
• are stored only on your iPhone, together with your progress. If you delete the Game and have no backup, they are lost and we cannot restore them.

4. Purchases and ads

This version of the Game has no in-app purchases and shows no ads. If a future update adds optional in-app purchases or ads, we will post updated Terms on this page before that update is released. Any purchase would then be sold and charged by Apple, and its real-money price would be shown before you confirm it.

5. No paid random items

The Game has no randomised items for sale (“loot boxes”). Nothing in the Game can be exchanged for money or real-world prizes.

6. Play safely

Wreckshot is a video game. Its buildings, cannon, explosions and collapses follow game physics, not real-world physics, and every building in the Game is empty. Real demolition is done only by trained, licensed professionals with permits and safety zones. Never throw or fire objects at buildings, vehicles, people or animals, and never handle fuel, fireworks or explosives to copy anything you see in the Game. Take breaks, and do not play while driving or walking in traffic.

7. Fair play

Do not cheat, use bots, exploits, modified or unauthorised versions of the Game, or tools that change its data. Do not reverse engineer, decompile or copy the Game, except where the law allows it. Do not use the Game for anything unlawful, or try to interfere with its operation.

8. Our intellectual property

The Game and its content (the buildings, materials, cannon, demolition yard, effects, art, sounds, code, level designs, names and logos, including the name “Wreckshot”) belong to us or our licensors and are protected by law. Wreckshot is an original game by Celik Works. Its buildings, skyline, machines and hazard markings are our own designs, not real places or products. Wreckshot isn’t affiliated with or endorsed by any demolition company, equipment maker or other game. If you send us feedback or ideas, we may use them without any obligation to you.

Open-source software

The Game includes open-source software under the MIT License:

• planck.js: Copyright (c) Erin Catto, Ali Shakiba
• Capacitor: Copyright (c) 2017-present Drifty Co.
• Capacitor Haptics plugin: Copyright 2020-present Ionic
• Capacitor Preferences plugin: Copyright 2020-present Ionic

For all four, the licence reads:

Permission is hereby granted, free of charge, to any person obtaining a copy of this software and associated documentation files (the “Software”), to deal in the Software without restriction, including without limitation the rights to use, copy, modify, merge, publish, distribute, sublicense, and/or sell copies of the Software, and to permit persons to whom the Software is furnished to do so, subject to the following conditions:

The above copyright notice and this permission notice shall be included in all copies or substantial portions of the Software.

THE SOFTWARE IS PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.

The Game also includes Apache Cordova (Copyright 2012 The Apache Software Foundation; this product includes software developed at The Apache Software Foundation), licensed under the Apache License, Version 2.0. The full licence texts are included in the Game.

9. Disclaimers and liability

We work hard to keep the Game running, but it is provided “as is” and “as available”. As far as the law allows, we do not promise that it will always be available, uninterrupted or error-free, and we exclude implied warranties.

As far as the law allows, we are not liable for indirect, incidental or consequential losses. Our total liability to you for all claims about the Game is limited to the greater of the amount you paid us for the Game in the 12 months before the claim, or US$50. Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, gross negligence, wilful misconduct, or death or personal injury caused by negligence, or your mandatory consumer rights.

10. Changes, updates and ending

We may update, change or stop offering the Game or any feature. Some updates may be required to keep playing. You may stop playing at any time. We may suspend or end your licence if you seriously or repeatedly breach these Terms. Sections 3, 8, 9, 11 and 12 survive.

We may change these Terms. We will update the version and the “Last updated” date and, for material changes such as adding purchases or ads, post the new Terms here before the update that brings the change is released. If you keep playing after a change takes effect, the new Terms apply.

11. Governing law and disputes

Please contact us first at hello@celikworks.com. Most problems can be solved quickly, and we will try to resolve your complaint within 30 days.

These Terms are governed by the laws of the Republic of Türkiye. This does not take away the protection of the mandatory consumer laws of the country or US state where you live. You may bring a claim in the courts where you live, or in the courts of Ankara, Türkiye, where we are based. Consumers in Türkiye may also apply to consumer arbitration committees (tüketici hakem heyetleri) and consumer courts (tüketici mahkemeleri).

12. Apple-specific terms

Because you downloaded the Game from the Apple App Store:

• These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for the Game and its content.
• Your licence is limited to Apple-branded products you own or control, as the App Store Usage Rules permit (including Family Sharing where it applies).
• We, not Apple, are solely responsible for maintenance and support. Apple has no obligation to provide any maintenance or support for the Game.
• If the Game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Game to you. To the maximum extent the law allows, Apple has no other warranty obligation for the Game. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our responsibility, as far as these Terms do not exclude them.
• We, not Apple, are responsible for addressing any claims by you or a third party about the Game or your use of it, including product liability claims, claims that the Game fails to meet legal or regulatory requirements, and consumer protection, privacy or similar claims.
• If a third party claims that the Game or your use of it infringes their intellectual property, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
• You confirm that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
• You must follow any applicable third-party terms when using the Game.
• Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple may enforce them against you as a third-party beneficiary.
