Palette Pour Terms of Use
The rules for playing Palette Pour, for virtual items and purchases, and for the subscription, which renews automatically until you cancel it.
At a glance
- Palette Pour is free to download. Apple’s Standard End User License Agreement and these Terms apply.
- Coins and items have no real-money value and cannot be cashed out or traded.
- Apple sells every in-app purchase and handles payments and refunds.
- The subscription renews automatically until you cancel it in your Apple Account settings, at least 24 hours before the period (or free trial) ends.
- We do not sell paid random items. Reward videos are optional.
1. Agreement and eligibility
These Terms are an agreement between you and Muhammed Çelik, sole proprietor, trading as Celik Works (Türkiye) (“we”, “us”), for the game Palette Pour (the “Game”). By downloading or playing the Game you accept these Terms and confirm that you have read the Palette Pour Privacy Policy. If you do not agree, please do not play.
If you are under 18, or under the age of majority where you live, you may play only with the permission of a parent or guardian, who accepts these Terms for you and is responsible for your purchases. Parents can approve or block purchases with Apple’s Ask to Buy and Screen Time.
2. Your licence to play
On iPhone, the Game is licensed to you under Apple’s Licensed Application End User License Agreement (the “Apple Standard EULA”) and the App Store Usage Rules. These Terms add the rules for playing the Game and for virtual items, purchases and subscriptions. If these Terms conflict with the Apple Standard EULA about the licence itself, the Apple Standard EULA applies.
Within that licence, you may download and play the Game on devices you own or control, for your own non-commercial entertainment. The licence is personal, limited, non-exclusive, non-transferable and revocable. All rights not expressly granted remain with us and our licensors.
3. Virtual currency and items
The Game has a virtual currency (coins) and virtual items (such as boosters, lives, packs, paint-shop upgrades and subscription perks). They:
- have no real-world monetary value and cannot be exchanged for money, cashed out, sold, traded or transferred;
- are licensed to you under these Terms, not sold, and are used up when you spend them;
- may be changed or rebalanced as we run the Game. We will not remove an item you bought with real money without giving you an equal replacement or a refund, unless you breached these Terms or the law allows it.
The real-money price of every purchase is shown before you confirm it.
4. Purchases and the subscription
Who sells. In-app purchases are sold and charged by Apple through the App Store, under Apple’s terms. Apple handles refunds under its refund policy. Your statutory consumer rights are not affected.
One-time purchases. A purchase that removes forced ads between levels is yours to keep. Use Settings › Restore Purchases to restore it on another device that uses the same Apple Account. Coins, boosters, lives and packs are used up as you play: they are added to your game on the device where you buy them, are saved with your progress, and are not restored by Restore purchases.
Timed items. If the Game offers timed items, such as unlimited lives for a set time, the time shown on the item starts when you start it, and the Game shows when it ends.
Passes that do not renew. If the Game offers a pass for a set period (for example a season pass), it is a one-time purchase that lasts for the period shown before you buy. It does not renew automatically. When the period ends, the pass ends, and the rewards you have already claimed stay yours.
The subscription (auto-renewing)
The Game offers an optional subscription. Before you subscribe, the purchase screen shows its name, its length, its price (and the price per period where that applies) and what you get, with links to these Terms and to the Privacy Policy. In addition:
- Payment is charged to your Apple Account when you confirm the purchase.
- The subscription renews automatically for the same length at the then-current price, unless you turn off auto-renew at least 24 hours before the end of the current period.
- Your account is charged for the renewal within the 24 hours before the current period ends.
- You can manage or cancel the subscription at any time in your Apple Account settings: on iPhone, open Settings › your name › Subscriptions. Deleting the Game does not cancel a subscription.
- If you cancel, you keep access until the end of the period you have paid for. We do not refund partial periods, except where Apple’s policy or the law requires it.
- Free trial. A free trial may be offered to new subscribers (once per Apple Account). The purchase screen shows the trial’s length, the date it ends and the price you will be charged after it. If you do not cancel at least 24 hours before the trial ends, the paid subscription starts automatically and you are charged that price. Any unused part of a free trial ends when you buy a subscription.
- If the price changes, Apple tells you in advance and, where its rules require it, asks for your consent first.
- The subscription works on all your devices that use the same Apple Account and have the Game installed. It is not shared through Family Sharing.
- When the subscription ends, its perks stop at the end of the paid period. Coins and items already added to your game stay yours.
Refunds and chargebacks. To request a refund, use reportaproblem.apple.com (see Support). If a purchase is refunded or reversed, we may remove the items or currency it gave you. We will not otherwise lock you out of the Game for asking for a refund.
5. No paid random items
We do not sell randomised items (“loot boxes”). Free rewards in the Game show their contents before you claim them. No item in the Game can be exchanged for money or real-world prizes.
6. Ads
The Game shows ads from third parties. Reward videos are optional, and you get the reward described when the ad finishes. The Game may show ads between levels. A one-time purchase removes those, while reward videos stay available if you want them. If an ad seems wrong, use Settings › Report an ad. How ad partners use data is explained in the Privacy Policy.
7. Fair play
Do not cheat, use bots, exploits, modified or unauthorised versions of the Game, or tools that change its data or traffic. Do not reverse engineer, decompile or copy the Game, except where the law allows it. Do not use the Game for anything unlawful, or try to interfere with its operation. If you breach this section, we may remove affected items or progress, or suspend your access, as far as the law allows.
8. Our intellectual property
The Game and its content (art, levels, music, sounds, code, names and logos, including the name “Palette Pour”) belong to us or our licensors and are protected by law. Third-party credits and licences are listed in the Game’s Settings, under credits and licences. If you send us feedback or ideas, we may use them without any obligation to you.
9. Disclaimers and liability
We work hard to keep the Game running, but it is provided “as is” and “as available”. As far as the law allows, we do not promise that it will always be available, uninterrupted or error-free, and we exclude implied warranties.
As far as the law allows, we are not liable for indirect, incidental or consequential losses. Our total liability to you for all claims about the Game is limited to the greater of the amount you paid for the Game and in-game purchases in the 12 months before the claim, or US$50. Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, gross negligence, wilful misconduct, or death or personal injury caused by negligence, or your mandatory consumer rights.
10. Changes, updates and ending
We may update, change or stop offering the Game or any feature. Some updates may be required to keep playing. If we stop operating the Game, we will give reasonable notice in the Game and stop selling items that would no longer be usable. You may stop playing at any time. We may suspend or end your licence if you seriously or repeatedly breach these Terms. Sections 3, 8, 9, 11 and 12 survive.
We may change these Terms. We will update the “Last updated” date and, for material changes, tell you in the Game before they apply. If you keep playing after a change takes effect, the new Terms apply.
11. Governing law and disputes
Please contact us first at hello@celikworks.com. Most problems can be solved quickly, and we will try to resolve your complaint within 30 days.
These Terms are governed by the laws of the Republic of Türkiye. This does not take away the protection of the mandatory consumer laws of the country or US state where you live. You may bring a claim in the courts where you live, or in the courts of Istanbul, Türkiye. Consumers in Türkiye may also apply to consumer arbitration committees (tüketici hakem heyetleri) and consumer courts (tüketici mahkemeleri).
12. Apple-specific terms
Because you downloaded the Game from the Apple App Store:
- These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for the Game and its content.
- Your licence is limited to Apple-branded products you own or control, as the App Store Usage Rules permit (including Family Sharing where it applies).
- We, not Apple, are solely responsible for maintenance and support. Apple has no obligation to provide any maintenance or support for the Game.
- If the Game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Game to you. To the maximum extent the law allows, Apple has no other warranty obligation for the Game. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our responsibility, as far as these Terms do not exclude them.
- We, not Apple, are responsible for addressing any claims by you or a third party about the Game or your use of it, including product liability claims, claims that the Game fails to meet legal or regulatory requirements, and consumer protection, privacy or similar claims.
- If a third party claims that the Game or your use of it infringes their intellectual property, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
- You confirm that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
- You must follow any applicable third-party terms when using the Game.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple may enforce them against you as a third-party beneficiary.
